Upon becoming a member of any Values PendulumTM program, the Member has engaged in an agreement with Capability Development Solutions being the owner, creator, developer, facilitator, trainer, certifier and deliverer of the Values PendulumTM material and course.
Under this agreement the Member agrees:
To pay ongoing regular payments, if completing their payment via ongoing payments, to Capability Development Solutions beginning within 30 days of enrollment, as required by Capability Development Solutions
To indemnify and keep indemnified Capability Development Solutions from and against all loss, damage or liability (whether criminal or civil) suffered and legal fees and costs incurred by Capability Development Solutions resulting from breach of this agreement by the Member including if applicable any neglect or default of the Member’s employees or agents
That payment of the investment amount to Capability Development Solutions entitles the Member to attend the Course and receive materials from Capability Development Solutions, as owned, developed and delivered by Capability Development Solutions throughout the duration of the Course
Values PendulumTM is a trademark of Capability Development Solutions
Certification as a Values PendulumTM Consultant (Personal, Business or other) requires the member to sign a Licence Agreement with Capability Development Solutions
That upon enrolling in a Values PendulumTM Course the Member is entering into an agreement with Capability Development Solutions and permits Capability Development Solutions to acquire their personal details to ensure delivery of the program directly
As a result of enrolling in a Values PendulumTM Course the Member becomes a Member of Capability Development Solutions
Not to cause or permit anything which may damage or endanger the intellectual property of Capability Development Solutions or assist or allows others to do so (Capability Development Solutions intellectual property includes all aspects of Capability Development Solutions intellectual property in whatever form associated with Capability Development Solutions, including but not limited to the rights contained in their website, stationary, customer lists, graphics, literature, style of trading, copyright, design rights, patents, logos, course materials and content etc)
Not to make copies or distribute any of the written or audio materials from the training provided by Capability Development Solutions other than as required to do so for the purpose of participating in the Course. Except as this Agreement specifically permits, at any time to divulge to any third party any part of the Confidential Information or of the Intellectual Property nor provide to any third party a copy of any document or audio recording which comprises or contains Confidential Information or Intellectual Property
These terms and conditions apply to both the Course and the continued use of the Values PendulumTM Profiling tool
Courses and course fees are non transferable
That any publicity or information provided by Capability Development Solutions in relation to the provision of the Course are for guidance only and are subject to alteration from time to time without consent from the Member
That in the event that Capability Development Solutions is liable to any extent under this agreement or under general law Capability Development Solutions liability is to be limited to the amount of the Fee paid by the Member
That Capability Development Solutions are not liable in any way if the Course contains materials which the Member is already familiar with
That Capability Development Solutions has not made any representation that participation in the Course guarantees success as a Values PendulumTM Consultant (Personal, Business or other) or will guarantee income
To have understood the terms of this agreement
To behave in an ethical and appropriate manner throughout their training and when dealing with all Capability Development Solutions staff, contractors, trainers, students, clients etc
All differences which may arise as a result of this agreement shall be referred to a single arbitrator to be agreed upon by the parties
That the training sessions required to participate in may be personally, emotionally and physically challenging for me and that they may be occasions in which emotional challenges including frustration, annoyance or stress may occur
That they have undertaken any necessary tests or investigations with a suitably qualified expert before commencing training to ensure that they are physically, mentally and emotionally fit for it
Not to hold Capability Development Solutions liable for any loss or cost or damages incurred personally (or any relation) in the event of mental, physical, emotional stress or distress (or other ailment or condition) caused either directly or indirectly in relation to the Course. As a member of the program the member indemnifies Capability Development Solutions in the event of any such claim
To advise Capability Development Solutions if the member wishes to change the date of their training and will do so advising Capability Development Solutions in writing and is to receive a confirmation of their request, and the request must be outside 30 days of the training date. Each request to change a confirmed training date will attract a $500 fee per request. Where training is within 30 days of written request to change dates, the member may be liable for the full value of that training. Decisions of this nature will be at the discretion of Capability Development Solutions
Acknowledges some training sessions will be recorded for training and marketing purposes for the use of Capability Development Solutions only
Capability Development Solutions reserves the right to change the training date or venue at any point prior to the training in order to best serve the needs of the members
Capability Development Solutions reserves the right to deny entry into the program or to suspend or remove members from the program
These terms and conditions are subject to change upon the discretion of Capability Development Solutions. Members continued use of the websites and/or participation in the program is deemed to be acceptance of these terms and conditions and any updates made
